OVERVIEW

Welcome to Runway Whisper.

The terms “we”, “us” and “our” refer to Runway Whisper. Runway Whisper operates this online store and website, including the information, content, features, products and services made available through it (the “Services”).

Runway Whisper is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies referred to in them, describe the terms that apply when you access our website or purchase products from Runway Whisper.

By accessing or using our Services, you agree to these Terms and our Privacy Policy.

Runway Whisper is a curated online fashion retailer.

We make reasonable efforts to accurately describe and display our products, including colours, materials, sizing and appearance. However, colours and appearance may vary slightly depending on your device, display settings, photography and lighting.

Product availability, descriptions and prices may change from time to time.

Nothing in this section limits your rights under the Australian Consumer Law, including consumer guarantees that goods be of acceptable quality, match their description and be fit for any disclosed purpose where those guarantees apply.

SECTION 3 — ORDERS

When you place an order with Runway Whisper, you are making an offer to purchase the products in your order.

An order is subject to acceptance by Runway Whisper. We may decline or cancel an order where reasonably necessary, including because of product unavailability, an obvious pricing or listing error, suspected fraudulent activity or an inability to fulfil the order.

If we cancel an order after payment has been taken, we will refund the relevant amount paid.

Please check your order information carefully before submitting your order. If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled once processing has commenced.

Returns, exchanges and refunds are governed by our Return & Refund Policy and applicable Australian Consumer Law.

SECTION 4 — PRICES AND PAYMENT

Prices displayed by Runway Whisper are shown in the currency indicated on the website or at checkout.

The final price payable, including any applicable delivery charges, will be shown before you complete your purchase.

Prices, promotions and discounts may change without notice, but changes will not affect an order already accepted by us unless required by law or agreed with you.

You agree to provide accurate and authorised payment information when making a purchase.

SECTION 5 — SHIPPING AND DELIVERY

Runway Whisper currently delivers to customers throughout Australia in accordance with our Shipping Policy.

Estimated delivery timeframes are displayed on our website and/or at checkout. Delivery timeframes are estimates and may occasionally be affected by carrier delays, public holidays, customs processing or other circumstances outside our reasonable control.

Where tracking information is available, it will be provided after your order has been dispatched.

SECTION 6 — AUSTRALIAN CONSUMER LAW

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances and the nature of a failure, you may be entitled to a repair, replacement, refund and/or compensation for reasonably foreseeable loss or damage.

Any voluntary return, exchange, warranty or other policy offered by Runway Whisper operates in addition to, and does not replace or limit, your rights under the Australian Consumer Law.

Unless otherwise stated, the content made available through the Runway Whisper website—including our branding, text, graphics, layout and original content—is owned by or licensed to Runway Whisper and is protected by applicable intellectual-property laws.

You may use our website for personal, non-commercial purposes.

You must not reproduce, distribute, modify, republish or commercially exploit our original website content without permission, except where permitted by law.

Third-party trademarks, product images and other third-party material remain the property of their respective owners.

Runway Whisper is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Runway Whisper.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Runway Whisper, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Runway Whisper.

SECTION 11 — PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify and other service providers may process information necessary to provide our ecommerce, payment and related services.

To the maximum extent permitted by law, we do not provide additional warranties beyond those expressly stated by Runway Whisper.

However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

SECTION 18 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Runway Whisper will not be liable for loss or damage that is not reasonably foreseeable or that is caused by circumstances for which Runway Whisper is not legally responsible.

Nothing in these Terms excludes, restricts or modifies liability, rights or remedies where doing so would be unlawful, including rights and remedies arising under the Australian Consumer Law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you are responsible for loss suffered by Runway Whisper as a direct result of your unlawful use of the Services or your material breach of these Terms.

Nothing in this section limits any rights or protections available to you under applicable consumer law.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or severed to the extent necessary, without affecting the remaining provisions.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

A failure by Runway Whisper to immediately exercise a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies referred to in them and any terms presented to you during checkout, form the agreement governing your use of the Services and purchases from Runway Whisper, subject always to applicable law.

SECTION 22 — ASSIGNMENT

You may not assign your rights or obligations under these Terms without our consent where consent is reasonably required.

Runway Whisper may transfer its rights and obligations where permitted by law, including in connection with a sale, restructuring or transfer of the business.

SECTION 23 — GOVERNING LAW

These Terms are governed by the laws applicable in South Australia, Australia.

You and Runway Whisper submit to the jurisdiction of the courts and tribunals of South Australia and any courts competent to hear appeals from them, subject to any rights you may have under applicable consumer law.
